Question:
As Salaamu Alaikum,
I pray that Allah (Almighty) sends His peace and blessings on our Beloved Rasul (ﷺ). I constantly have a sticky substance which leaks from my private parts and it never stops and I get Wasaawis that my Ibaadat aren’t being accepted because I’m naapaak. Ive read online fatwa from islamqa that a person is Ma’zoor if they go through a constant problem like this. Now the issue is, when it comes after Fajr, I have to do Wudhu again to pray Ishraaq as my Wudhu is nullified once its sunrise time. Is there any leeway for me to not do Wudhu just for Ishraaq time as I’ve been missing Ishraaq for a long time now because it’s very difficult for me to do Wudhu. I have heard in the Maliki Fiqh that a Ma’zoor person’s Wudhu will only break if something other than his Ma’zoor problem breaks his Wudhu, but Wudhu won’t break at the end of Salaah time. Should I follow the Maliki Madhab? It will be difficult for me to change Madhab, but is there any leeway for me whilst being in the Hanafi Madhab where my Wudhu doesn’t break after Salaah time ends? I just want an honest ruling as this is an Amaanah, whatever ruling is given by you, I will keep it to myself and Allah (Almighty) and not share it with anyone else. I’m just finding it very difficult and I’m sure that Allah (Almighty) has made Deen easy and not hard. May Allah (Almighty) grant you the best of both worlds, Aameen.
Answer:
حامدا و مصليا و مسلما
Wa Alaikumus Salaam Wa Rahmatullahi Wa Barakatuhu,
The Honorable Jurists have written that one of the fundamental conditions in order to follow the opinion of another Madhab or to choose the non-authoritative opinion, is that one must be in a severe need or in a critical situation such that without that option, much harm will be caused to him. As for the performance of Salatul Ishraaq, this is a very blessed practice, but it is not an obligatory prayer which binds one to perform it. Therefore, this does not qualify one to be in a dire need or situation for choosing the non-authoritative opinion or leaving the Hanafi Madhab for its performance.
The authoritative and chosen opinion in the Hanafi Madhab, is that an excused person who intends to perform Salah, will need to repeat his Wudhu upon the exiting of every obligatory Salah time. Therefore, once Fajr time ends and the sun rises, you will need to repeat your Wudhu to perform Salatul Ishraaq.
I hope and pray that Allah (Almighty) grants you complete cure and enable you in continuing with your optional practices, Insha Allah.
And Allah Almighty knows best.
