Kufr Causing Talaaq

Question:
As Salaamu Alaikum.

Hanafi Fiqh Question: If a Muslim in London commits and act of kufr that nullifies his nikah does the annulment that takes place because of that count as a talaaq divorce?

Answer: Wa Alaikum As Salaam,

This act brings about a break in the marriage. However, a responsible Muslim scholar acting as a Qadhi, has to create a separation between the spouses. This separation will then have the ruling of a divorce.
