QUESTION:
As Salaamu Alaikum,
I wanted to ask you about the ruling on day trading and whether there is any permissible way for me to earn an income through it.
I understand that there is a difference of opinion among scholars regarding day trading, particularly with stocks, and I want to follow the correct Islamic ruling rather than simply do what is convenient for me.
At the moment, I am unemployed and actively looking for work. I have a master’s degree as well as professional certifications, and I have been applying for many different jobs, including jobs outside of my field. Unfortunately, I have even applied for positions such as at Walgreens and security jobs, but I keep receiving responses saying that they have chosen another candidate. It has become very frustrating, and currently I do not have a job or a reliable source of income.
Because of my situation, I wanted to ask: if I am unable to find employment, would it be permissible for me to earn my living through day trading stocks, provided that I only trade Shariah-compliant stocks and avoid interest, margin, short selling, options, and any other transactions that are impermissible?
If day trading itself is not permissible, is there any difference if it is only temporary, while I continue looking for employment and have no other source of income?
Also, if a particular form of trading is considered impermissible, would donating a portion of the profits to charity make it permissible, or would the income still be considered impermissible? I do not want to justify something haram simply because I am in a difficult situation, so I would appreciate clarification on this point.
I am genuinely trying to find a halal way to support myself while continuing to look for a job. Please advise me on what would be permissible in my circumstances and, if trading is not permissible, what alternatives you would recommend for earning halal income.

Wa Alaikum As Salaam,
Day Trading is generally NOT considered permissible, even if you trade in Shariah Compliant stocks and avoid other impermissible dealings. The scholars of Islamic Finance have allowed investing in shares and trading in stocks when: –
- The Company’s main business is Halal.
- The Company does not have excessive interest – bearing debt.
- You actually take ownership of the share and bear its risk before selling it.
This last condition is not found in day trading, because the purpose of the day trading is not to own the company and take profit from its business. Instead, it is to profit from the price fluctuation in a short period of time and this is ‘speculation’ which is prohibited.
The reasons why day trading is considered as impermissible are: –
- In day trading, you sell what you don’t earn. You sell the same day before you legally own the share and have taken possession of it, and it is not permissible to sell before taking possession.
- Day trading is dependent on chart movements, and not real ownership. It is therefore closer to gambling than genuine business activity.
- Most day trading platforms use margin (borrowing on interest) and allow short selling, and both are not permissible.
Being unemployed, and struggling to find a work is a great hardship and a test from Allah. However, this does not give you the allowance to earn a living through a trade which is deemed to be impermissible in Islam.
The scholars have explained that a Muslim must not enter an unlawful profession, even though it is temporary. Entering into a profession with a temporary intention does not change the nature of the transaction.
My advice to you is that you should continue to seek Halal employment, even if it is below your qualification. Any Halal job, however small, is more blessed than earning an income which is unlawful or doubtful.
If you wish to trade and invest, then do so in long-term investments where the stocks are certified as Halal, and trade with the intention of ownership, not daily flipping.
You can also give consideration to other permissible self-employment jobs connected to your field like tutoring or small trade.
With all the above, continue to make Istighfaar and dua to Allah, for certainly, He is the Provider, Sustainer and Nourisher of His entire creation.
